PUBLIC TOURISM TRUST FOR THE PROMOTION AND ADVERTISING OF THE MUNICIPALITY OF PUERTO VALLARTA NUMBER 24827, hereinafter identified as FIDETURPV, with address located at Lago Tangañica #222, Fraccionamiento Fluvial Vallarta, C.P. 48312, in Puerto Vallarta, Jalisco, Mexico, in accordance with articles 1, 6 and 16 of the Political Constitution of the United Mexican States; 1, 27 and 28 of the General Law on Protection of Personal Data in Possession of Obligated Subjects; and 1, 3 point 1 sections III and XXXII, 23, 24 and 87 point 1 sections I and X Law on Protection of Personal Data in Possession of Obligated Subjects of the State of Jalisco and its Municipalities, informs you that it is responsible for the use and protection of your personal data, and in this regard issues this privacy notice for personal data in possession of private parties, to inform you of the terms and conditions of the treatment of your personal data.

The information that you provide to FIDETURPV or its staff, in writing, verbally, by telephone or online and that we will use may include personal identification, contact, employment and financial data, mentioned in an enunciative but not limiting manner below:

1. Name, address, date of birth, age, gender and marital status.
2. Handwritten signature, photograph
3. Email and telephone number.
4. Your financial data or financial information, such as bank accounts, credits, movable and immovable property, assets, liabilities, credit card number, among others.
5. Your employment data such as occupation, current employment, telephone, email and source of work.
6. Information about your spouse or children.
7. Official documents that prove your identity and the information you declare, as well as your RFC and CURP.
8. To ensure that the personal data provided is correct and current, FIDETURPV may collect information from other sources.

FIDETURPV states that with respect to data classified as Sensitive Personal Data, FIDETURPV must make reasonable efforts to limit their treatment, so that it is the minimum necessary to fulfill the purpose for which they were collected and for which the Holders grant express consent for their Sensitive Personal Data to be treated.

The veracity of the information provided by the Holders to FIDETURPV is the responsibility of whoever delivered said information, therefore it will not be responsible for the accuracy, validity and authenticity of the personal data provided. FIDETURPV will inform the Holders of the mechanism for the rectification of personal data that it considers pertinent, in order to keep them duly updated and which will be specified later in this notice.

FIDETURPV collects your personal data and will use it for the main purposes that are necessary for the service you request and that are listed below:

• Promotional actions of the Tourist Destination of Puerto Vallarta, Jalisco.
• For marketing, advertising purposes or to contact you, inform you and offer you promotions.
• Confirm your identity and verify the information you provide us.
• Comply with applicable regulatory provisions.
• If you do not want your personal data to be processed for additional purposes, you can submit a written document to our address at this time, stating the above.
• Build a database.
• Provide legal security and certainty to facts and acts.
• The refusal to use your personal data for these purposes may not be a reason for us to deny you any service.

Likewise, FIDETURPV collects your personal data, which it will use for secondary purposes that are not necessary for the service, which allow us and facilitate us to provide you with better care, which are listed below:

• To contact you, inform you, provide feedback and offer you our services.
• For marketing, advertising or commercial prospecting purposes on our part.

If you do not want your personal data to be processed for these additional purposes, you can submit a written document to our address at this time, stating the above. The refusal to use your personal data for these purposes may not be a reason for us to deny you the services you request or contract with us.

Your personal data is processed by FIDETURPV staff and may be transferred to national or foreign third parties, for the purposes mentioned in the previous point; at the request of an authority and to fulfill obligations before competent authorities.

The personal data that you provide to FIDETURPV can be compiled and recorded in databases. FIDETURPV is not responsible for the content and privacy policies of external sites of the FIDETURPV portal.

We inform you that for the transfers of your information we require your consent, if you do not express your refusal for said transfers, we will understand your consent granted. In case of refusal, you can submit a written document to our address at this time, stating the above.

You can limit the use and disclosure of your personal information or revoke the consent you have granted, through a written request delivered to our address.

In addition to the above, to limit the use and disclosure of your personal information, you need to carry out the following means:

• Your registration in the Public Registry to Avoid Advertising, which is in charge of the Federal Consumer Protection Agency, so that your personal data is not used to receive advertising or promotions from companies of goods or services. • Your registration in the corresponding exclusion list, so that your personal data is not processed for marketing, advertising or commercial prospecting purposes on our part.

However, it is important that you keep in mind that not in all cases will we be able to attend to your request or conclude the use of your information immediately, since it is possible that due to some legal obligation we need to continue processing your personal data. Likewise, you should consider that for certain purposes, the revocation of your consent will imply that we cannot continue to provide you with the service you requested.

You have the right to know what personal data we have about you, what we use it for and the conditions of use that we give them (Access). Likewise, it is your right to request the correction of your personal information in case it is outdated, inaccurate or incomplete (Rectification); that we eliminate it from our records or databases when you consider that it is not being used in accordance with the principles, duties and obligations provided in the regulations (Cancellation); as well as to oppose the use of your personal data for specific purposes (Opposition). These rights are known as ARCO rights.

For the exercise of any of the ARCO rights, you must submit the respective request in writing to our address. Said request must contain at least your full name, address, documents that prove your identity, clearly indicating the relationship link with FIDETURPV and specifying clearly and precisely the personal data for which you request access, rectification, updating or cancellation, the elements or documents where the personal data may exist and indicating the reasons why you wish to access your personal data, or the reasons why you consider that your data should be updated, rectified or cancelled.

From receipt, the Data Privacy area will have a period of 20 business days to respond to your request; however, said period may be extended for an equal period of time, which will be notified to you, by the means you have indicated to us for such purposes, indicating the reasons for said extension.

Likewise, we inform you that, if applicable, you can initiate the ARCO Rights Protection procedure before the Federal Institute of Access to Information and Protection of Personal Data (IFAI), within 15 days following the date on which FIDETURPV responds to your request and it is not satisfactory to you, or if the indicated term has elapsed, FIDETURPV does not respond to your request.

FIDETURPV continuously takes photographs and/or videos of day-to-day activities and special events with the purpose of promoting and advertising the tourist destination in its own and third-party publications, including but not limited to web pages, social networks, brochures and/or advertising media. No financial compensation is granted to the person or persons who appear within the collection of these images or material.

The Holders, state that they have the legal capacity and representation required to acquire rights and obligations and that by signing this Notice, they have been informed of the conditions on the protection of personal data, photographs and videos, expressly expressing their consent to the Treatment of the same by the Responsible, in the manner and for the purposes mentioned in this Privacy Notice.

As regards the Holders, of personal data prior to the entry into force of the "Law", they state that they have been informed through the issuance of the corresponding circular, regarding the terms and conditions of this Privacy Notice, being granted a period of ten (10) calendar days following the receipt of the aforementioned circular to express their opposition to it, otherwise, it will be understood that they tacitly consent to the Privacy Notice, in accordance with article 8 of the "Law".

Likewise, it is made known to the Holders that in the event that FIDETURPV intends to carry out a treatment different from the purpose described in the Privacy Notice, it must request their consent again in accordance with the provisions of article 12 of the "Law".

The holder of personal data states that they have read and agree with the terms and conditions of the Privacy Notice, knowing the purpose of the collection and treatment of their personal data, as well as the procedure for exercising their ARCO Rights.
